1. Company Information
The Links Keeper LLC is a limited liability company organized under the laws of the State of New York. All transactions and agreements are governed by the laws of the State of New York.
2. Product Use, Intended Purpose & Safety Warnings
All products sold by The Links Keeper LLC—including the Apex Marker Display—are intended strictly for decorative and milestone display purposes. Customers are responsible for ensuring that any product purchased is appropriate for their intended residential or commercial use.
Weight & Structural Load: Our display cases are substantial physical items engineered from solid hardwoods, structural mounting panels, and permanent rare-earth neodymium magnets. A fully loaded display case carries significant weight. Customers are solely responsible for ensuring that their chosen mounting surface, drywall, or architectural substrate can safely bear the total loaded weight.
Installation Responsibility: The customer assumes full, sole responsibility for the proper and secure installation, wall anchoring, and hanging of all products. The Links Keeper LLC strongly advises anchoring wall fixtures directly into wall studs or utilizing professional, heavy-duty anchors rated in excess of the loaded product. Any guidance, mounting templates, or hardware provided are offered strictly as a courtesy and do not constitute certified professional installation advice.
Disclaimer of Liability for Installation: To the fullest extent permitted by law, The Links Keeper LLC explicitly disclaims any liability for personal injury, property damage, falling objects, or injury to pets or third parties resulting from improper mounting, structural failure of the wall, or user error during or following installation.
3. No Warranty
Products are sold as described at the time of purchase. Handcrafted timber products inherently feature natural variations in grain, tone, and character. The Links Keeper LLC makes no express or implied warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose, beyond what is explicitly stated in our official product specifications. We reserve the right to refine or modify specifications, components, or tolerances at any time in the pursuit of product excellence.
4. Limitation of Liability
To the fullest extent permitted by applicable law, The Links Keeper LLC, its members, officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the purchase, use, misuse, installation, or inability to use our products. Your use and display of our products is at your sole risk. In no event shall our total aggregate liability to you exceed the actual dollar amount paid by you for the specific product or reservation giving rise to the claim.
5. Production Run Reservations & Two-Stage Billing
The Links Keeper LLC offers limited allocations, including small-batch first production runs, operated through a two-stage deposit and reservation system:
- Initial Reservation Deposit: Securing an allocation in an upcoming production wave requires a non-transferable, one-time deposit (e.g., $100.00 USD), charged immediately at checkout via our authorized payment processor. Placing a deposit confirms your reservation and assigns your spot in the handcrafted production queue.
- Balance Due Prior to Dispatch: The remaining product balance (e.g., $349.00 USD, plus applicable state/local sales tax and shipping fees) will be invoiced and billed when your unit is completed, boxed, and scheduled for final carrier handoff. Final dispatch will not occur until all outstanding balances have cleared.
- Deposit Refund Policy: Reservation deposits are fully refundable at any time upon request prior to the issuance of your final balance invoice and carrier shipping notification. If you decide to release your spot before your piece is prepped for shipment, simply reach out to us and we will promptly refund your deposit to the original payment method.
- Estimated Production & Fulfillment Windows: Stated production, assembly, or shipping windows are good-faith estimates only. Because our displays rely on fine woodworking, hand-upholstered fabric wrapping, and custom tolerances, timelines may shift due to material sourcing, artisan labor, or logistics delays. We will make reasonable efforts to communicate production milestones via email. Unforeseen delays do not constitute breach of contract.
- Allocation Cancellation by The Links Keeper LLC: We reserve the right to cancel any reservation or pre-order at our sole discretion (for instance, due to unforeseen supply chain halts or discontinued materials). In such an event, you will receive prompt written notice and a 100% full refund of any deposit or payments collected.
6. Typographical Errors, Pricing & Order Refusal
The Links Keeper LLC strives to ensure all online pricing, product imagery, dimensions, and specifications are accurate. However, typographical errors, system glitches, or technical omissions may occur.
We reserve the right to revoke, cancel, or refuse any order placed for a product listed at an incorrect price or with erroneous specifications, regardless of whether your order was confirmed or your card charged. If your payment method has already been debited and the order is cancelled, we will immediately credit your original payment method in full.
7. Returns & Refunds (Delivered Goods)
We want you to love your display. Following delivery, if you are unsatisfied with your purchase, you have 30 days from the verified date of delivery to return it at your cost. To qualify for a refund, the display must arrive back in new, sellable condition, unaltered, and packaged in its original protective packaging, subject to inspection upon receipt.
Customers are responsible for return shipping arrangements and carrier costs unless the item arrived damaged or defective. The Links Keeper LLC is not responsible for items lost or damaged during return transit.
8. Shipping, Delivery & Risk of Loss
We currently ship to addresses within the United States only. The Links Keeper LLC is not responsible for transit delays, weather disruptions, or carrier mishandling once a shipment has been handed off to the logistics carrier (e.g., UPS, FedEx, or USPS). Title and risk of loss transfer to the customer upon delivery of the package to the carrier. While we will make reasonable efforts to assist customers in resolving transit claims, we cannot guarantee carrier transit times.
9. Sales Tax
Applicable state and local sales taxes are automatically calculated and collected at checkout based on the delivery destination provided, processed securely via our payment provider in accordance with applicable tax regulations.
For shipments where tax is not collected at checkout, customers remain responsible for complying with any applicable local use taxes required by their governing authorities.
10. Intellectual Property
All content presented on our website, social media, marketing collateral, and packaging—including but not limited to brand names (“The Links Keeper”), logos, product designs, CAD structures, custom magnetic slat architectures, photography, and written text—is the exclusive intellectual property of The Links Keeper LLC. Any unauthorized reproduction, commercial distribution, adaptation, or imitation is strictly prohibited.
11. User Conduct
By accessing our website or placing an order, you agree not to engage in unlawful, abusive, or fraudulent activity, including payment fraud, unauthorized access attempts, system tampering, or actions that impair the website's functionality.
12. Privacy Policy & Tracking Notice
Your use of our website and purchase workflow is also governed by our Privacy Policy, which is incorporated into these terms by reference. Our website utilizes modern analytics and advertising technologies (such as cookies, Google Analytics, and Meta Pixels) to enhance user experience and measure marketing campaigns. 13. California Proposition 65 Notice
Our products incorporate natural hardwood components, rare-earth neodymium magnets, structural adhesives, and protective finishes. 14. Governing Law & Exclusive Jurisdiction
These terms, transactions, and any dispute arising out of or related to your interaction with The Links Keeper LLC shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
Any legal proceedings, actions, or suits arising under or related to this agreement shall be filed exclusively in the state or federal courts located in Kings County, Brooklyn, NY, and both parties irrevocably submit to the personal jurisdiction and venue of such courts.
15. Dispute Resolution & Informal Negotiation
In the event of any controversy, claim, or dispute arising out of or relating to your purchase or these terms, both parties agree to first attempt in good faith to resolve the matter informally for a minimum period of thirty (30) days by contacting us directly via our contact form.
If informal resolution fails, any remaining claim shall be resolved exclusively through individual litigation in the courts of Kings County, Brooklyn, NY, or binding arbitration through the American Arbitration Association (AAA). Both parties explicitly waive any right to participate in or initiate a class-action lawsuit, collective action, or class-wide arbitration.
16. Changes to These Terms
The Links Keeper LLC reserves the right to amend, update, or replace these Terms of Use at any time. Any modifications will be posted directly to this page with an updated effective date. Continued use of our site or placement of an order following changes constitutes acceptance of the revised terms.
